Freight Claim
Policy

1. Purpose

This Freight Claim Policy outlines the procedures for reporting freight damage, shortages, concealed damage, or other shipping-related issues involving KPower Lithium products.

The purpose of this Policy is to ensure that freight-related claims are reported promptly, documented accurately, and processed efficiently while complying with carrier requirements and applicable transportation regulations.

This Policy should be read together with the KPower Dealer Direct Shipping Policy, Warranty Policy, and Terms & Conditions of Sale.


2. Scope

This Policy applies to all KPower Lithium products shipped to authorized dealers, distributors, installers, commercial customers, and retail customers where freight transportation is arranged by or on behalf of KPower Lithium.

It applies to shipments delivered by parcel carriers, Less-Than-Truckload (LTL) carriers, Full Truckload (FTL) carriers, freight forwarders, and other authorized transportation providers.


3. Inspection Upon Delivery

All shipments must be inspected immediately upon delivery and before the carrier's Proof of Delivery (POD) or delivery receipt is signed.

Customers should carefully examine:

  • Shipping cartons
  • Pallets
  • Protective packaging
  • Product packaging
  • Quantity of products received
  • Visible damage
  • Signs of mishandling
  • Water damage
  • Crushed cartons
  • Broken pallets
  • Missing packages

Acceptance of a shipment without noting visible damage may affect eligibility for freight claims.


4. Visible Freight Damage

If visible damage is discovered upon delivery, customers must:

  1. Clearly note all visible damage on the carrier's Proof of Delivery (POD) before signing.
  2. Photograph the shipment before opening any packaging where practical.
  3. Retain all original packaging materials.
  4. Notify KPower Lithium within 48 hours of delivery.

Failure to report visible damage within the required timeframe may result in denial of the freight claim by the carrier or KPower Lithium.


5. Concealed Damage

Concealed damage refers to damage discovered after unpacking that was not reasonably visible at the time of delivery.

Customers must:

  • Stop unpacking if significant damage is discovered.
  • Photograph the damaged product.
  • Photograph all packaging materials.
  • Preserve all cartons, pallets, and protective packaging.
  • Notify KPower Lithium within five (5) business days of delivery.

Concealed damage claims submitted after this period may not be accepted.


6. Shortages

Customers must verify that all products listed on the packing slip or shipping documentation have been received.

If products are missing, customers should:

  • Verify shipment quantities.
  • Review all packaging.
  • Compare received items with the packing slip.
  • Note shortages on the carrier delivery receipt when applicable.
  • Notify KPower Lithium promptly.

7. Required Documentation

To assist in evaluating a freight claim, customers should provide:

  • Order number
  • Invoice number
  • Tracking number
  • Carrier name
  • Product model
  • Product serial number(s)
  • Description of the issue
  • Photographs of the shipment
  • Photographs of damaged products
  • Photographs of packaging
  • Proof of Delivery (POD), if available
  • Any additional documentation reasonably requested by KPower Lithium

Incomplete documentation may delay claim processing.


8. Photograph Requirements

Photographs should clearly show:

  • Entire shipment
  • Pallet condition
  • Outer packaging
  • Inner packaging
  • Shipping labels
  • Carrier labels
  • Damaged areas
  • Product serial numbers where visible

Clear documentation significantly improves the likelihood of successful carrier claims.


9. Preservation of Packaging

Customers must retain all original packaging materials until the freight claim has been fully reviewed and closed.

Packaging should not be:

  • Discarded
  • Destroyed
  • Repaired
  • Altered

Carriers may require inspection of the original packaging before accepting responsibility for freight damage.


10. Claim Review Process

Upon receipt of a complete claim package, KPower Lithium will review:

  • Shipment documentation
  • Carrier information
  • Photographs
  • Product condition
  • Warranty status
  • Applicable shipping terms
  • Carrier investigation results, where applicable

Additional information may be requested during the review process.


11. Claim Resolution

Following review, KPower Lithium may, at its sole discretion and subject to applicable warranty terms and carrier findings:

  • Replace damaged products
  • Repair eligible products
  • Issue a credit
  • Assist with a carrier claim
  • Request return of damaged products
  • Decline the claim where supporting evidence is insufficient

Claim approval remains subject to verification and applicable shipping terms.


12. Exclusions

Freight claims may be denied where:

  • Damage is reported outside the required reporting period.
  • Packaging has been discarded before inspection.
  • Products have been modified or repaired before claim review.
  • Products have been improperly stored after delivery.
  • Damage resulted from improper installation or misuse.
  • Required documentation is incomplete or unavailable.
  • Damage occurred after confirmed delivery and acceptance.

13. Carrier Cooperation

Customers agree to cooperate with any reasonable carrier inspection or investigation.

This may include:

  • Providing additional photographs.
  • Making products available for inspection.
  • Retaining packaging materials.
  • Providing shipment documentation.
  • Assisting carrier representatives during investigation.

Failure to cooperate may affect claim eligibility.


14. Limitation of Liability

KPower Lithium is not responsible for:

  • Carrier transit delays
  • Consequential damages
  • Business interruption
  • Lost profits
  • Labor costs
  • Installation costs
  • Storage costs incurred after delivery
  • Damage occurring after confirmed acceptance of the shipment

Nothing in this Policy limits any rights that cannot legally be excluded under applicable law.

16. Policy Updates

KPower Lithium reserves the right to modify this Freight Claim Policy at any time to reflect operational requirements, regulatory changes, carrier requirements, or business practices.

Updated versions become effective upon publication unless otherwise stated.
